REVIEW THE INFORMATION BELOW REGARDING OUTDOOR BURNING

Outdoor burning within the City of Robinson is regulated to protect public safety, property, and air quality. All outdoor burns must comply with Texas Administrative Code Title 30 and City of Robinson ordinances. An approved Outdoor Burn Application is required before ignition. Burning without approval or outside approved conditions may result in fines or other enforcement action. The information below outlines the application process, requirements, and expectations for outdoor burning in Robinson. 

Rules, Requirements, and Expectations

The following requirements are derived from Title 30, Texas Administrative Code §§111.201–111.221 and the City of Robinson Code of Ordinances:  

  • A completed outdoor burning application must be submitted a minimum of three (3) business days prior to the requested burn date. Approval is not guaranteed.
  • Outdoor burning applications are only eligible for approval for crop clearing and brush burning.
  • The area around the pile must be cleared of grass and/or and other flammable materials to prevent fire spread.
  • The pile must be located at least three hundred (300) feet downwind of any structure or sensitive receptor.  
  • If smoke from the burn becomes bothersome or creates a nuisance, visibility hazard, or air quality concern, the fire shall be extinguished immediately upon direction of the Fire Department or Police Department.
  • The pile may only contain natural brush and tree limbs originating from the approved property listed on the application.
  • The burning of milled wood, treated lumber, trash, household waste, construction debris, or any other prohibited materials is strictly prohibited.
  • Wind speed must be no less than six (6) mph and no more than twenty-three (23) mph. Burning may commence no earlier than one (1) hour after sunrise and must be extinguished no later than one (1) hour before sunset.
  • The fire must be attended at all times by a responsible adult with the means to control and extinguish the fire.
  • Burning Prohibited. It shall be unlawful for any person to cause, suffer, allow, or permit any outdoor burning of trash, waste, rubbish, grass, brush, trees, or other material within the city, except as specifically authorized by this article. It shall also be unlawful for any person to cause, suffer, allow, or permit any domestic waste burning, as municipal waste collection is provided within the city.
  • Permissible Burning; Liability. It remains the responsibility of the person igniting the burn to comply with all meteorological conditions, time restrictions, and requirements of state and local law. Approval to conduct outdoor burning does not exempt any person from liability for damages, injuries, or violations resulting from the burn, even if otherwise conducted in compliance with applicable regulations.
  • Compliance with Applicable Laws. It shall be unlawful for any person to conduct outdoor burning in violation of any state statute, administrative rule, regulation, or applicable common law.

Exceptions to the Requirements Listed Above
Under the Outdoor Burning Rule, Title 30 Texas Administrative Code, the following activities are considered exempt from the above requirements when conducted in compliance with state law. Burning for:  

  • Warmth
  • Ceremonial purposes
  • Food preparation
  • Recreation

Burn Inspection Important Information

The Robinson Volunteer Fire Department is responsible for inspecting burn sites. It will be the responsibility of the person conducting the burn to monitor the fire. An approved application does not release the owner of the pile from any damages that may be caused by the burning of the pile. Burn application approvals will only be issued if all requirements are met.

Burn Bans & Red Flag Warnings

Burn bans are issued based on the determination made by McLennan County. To find whether a burn ban has been issued by McLennan County you can visit their Notice of Burn Bans and/or Disaster Declarations webpage.  McLennan County does have a Red Flag Warning Burn Ban Order in place. A Red Flag Warning Burn Ban Order bans any burning any time a Red Flag Warning has been issued by the National Weather Service.
